When the players decide to either take part or not in the settlement proposal the matter is sent back to the Federal courts in Minnesota. It's the height of absurdity for these plaintiffs to claim as if they were children who are not allowed dessert that the settlement "does not give enough benefit to the players who filed the suit."

If players opt out of the settlement are able to file personal lawsuits against the league. They could be more encouraged to do this in light of recent developments in the O'Bannon vs. NCAA case, too and now that former college players are filing lawsuits over the use of their images to play video games.

In July In July, The Ninth Circuit threw out an appeal brought by video game producer EA Sports. The decision dismissed the argument of EA that likenesses of players were protected under the First Amendment and it will allow the case to continue.

The Dryer plaintiffs are observing that case carefully. They're also monitoring another lawsuit that was filed by thousands of ex- Madden NFL 24 participants over concussions.

"I think there's some kind of correlation between the two at this point," Dryer said of the two cases. "The Madden NFL 24 is looking very capriciously and cavalierly at the concussion issues.

"There's a predisposed notion [from"the Madden NFL 24"Madden NFL 24"] of 'we want that, we're going to accept that.' There's an air of arrogance there."

Dryer is hoping that something can be worked out so that he and the other retired players negotiate a deal with Madden NFL 24 which would directly pay them for the use of their images while granting them the right to cheap mut 24 coins use it.
